Long post, but I hope it will help others with HDMI splitter and Dolby issues
Finally solved my dilemma last night.
I had a 10 year old Panny amp in my bedroom setup. Amp had no HDMI and I've been mickey mousing around with optical cables and optical splitters switches for years with the former TW equipment. But it did play Dolby sound thru tivo because unlike my living room set up I was not splitting the signal by HDMI to another TV in another room.
The tivo now plays 5.1 dolby and DD Plus thru bedroom tv with a mini and thru my few month old 5 port HDMI marantz amp that I had bot for my living room just a few months before I decided to go the tivo route.
The bedroom sounds great as there are many stations more now broadcasting in dolby and now I can simply stream thru the tivo . . . netflix and amazon too when movies are available in DD with no input changes.
I could never get the living room tivo set streaming or playing Dolby even though I just got another 5 HDMI marantz amp yesterday for the living room. Reason was because I was splitting the tivo signal one leg into the amp and then out to the living room tv. The other leg went from the HDMI splitter thru the HDMI cable to a small flat screen on my kitchen table.
But from my googling around I read that hdmi automatically downgrades the sound to just stereo when it senses the tv in the kitchen is not dolby.
I doubt even if I had an amp in the kitchen it could ever split the Dolby audio to both devices because . . . from my readings, this poster from the AVS forum said HDMI can "only send and stream one audio and one video signal at a time" it will automatically drop to stereo on both tv's.
Bottom line (which posters here were trying to help me with from other threads I started) . . . Seems there is no HDMI switch solution (currently) that can split and send both DD audio to two different tv's/sources unless you want to spend $200 for a special device (one of these type of devices is linked to in the thread below). And who knows if that will even play nice with a tivo unit or how long it lasts before burning out.
I could get two great video feeds, but never Dolby sound in my living room because of that HDMI splitter. The HDMI powered splitters are finicky anyway and id rather not use any if there is a better solution.
As soon as I heard how great the stations sounded and netflix thru the TV yesterday in my bedroom . . . I knew I had to get that living room working.
So i got to thinking . . . . in the last two weeks I already paid $28 for an extra remote for the kitchen tv to control the living room tivo thru hdmi. I also had to replace my 10 year old radio shack infrared remote extenders which just died with the x-10 extenders for $46.
If i simply do away with the hdmi cable and send those accessories back to amazon, ill get a credit for $72! instead of looking for an hdmi switch solution thats not available yet for cheap . . . im now only spending $52 more for my ultimate solution which is yet another mini.
It was frustrating because whats the point of having 5 speakers around me in my living room and another set in my bedroom (plus bass speakers) in each room if the system is only putting out 2 speaker boring flat sounding stereo in my living room setup all because of the damn HDMI splitter.
Note: I could always get Dolby thru streaming netflix or amazon thru my Apple TV, my samsung smart tv or my PS3 in my living room. But never DD thru the tivo . . . because of using that HDMI splitter going to a kitchen tv.
Now im chucking the HDMI splitter set up and going to use another new mini in the kitchen. I was already using two minis in other rooms and they are great. I foolishly was trying to save a few bucks since I already owned a powered HDMI splitter and a 35 foot HDMI cable from a former house set up.
Moral of my solution for others is just get another mini instead of trying HDMI splitters or other solutions to think you will save money from having to add yet another mini, which IMO for a mini is dirt cheap for what it does.
And the ease of connecting my kitchen tv with an HDMI cable from the mini and the coax to my moca network (which still amazes me how it does this). Plug in the ac adapter and I'm going to be good to go for Dolby again thru the tivo in my living rooom.
One of the best features of the tivo is its ability to be a one button tivo remote solution for my wife (and me too) as even though we use harmony 650's and they are cheap and work great (like $59 each on sale) for changing inputs and devices . . . but they are still somewhat confusing to get to the hidden screens for apple tv's and my ps 3's. The better harmony's that show all buttons on screen at once are way expensive especially for two.
Was free 2 day shipping and no tax on the tivo mini too.

Here is the thread I found where the poster was trying to split an hdmi signal like i was doing, but learned it can't be done:
